TRAVELER TERMS AND CONDITIONS (the “Agreement”)
This Agreement is made, for good and valuable mutual consideration, between the named Traveler and Global CommUnity, LLC dba Global CommUnity. The Agreement is intended to outline, define, and limit the respective roles and responsibilities of the various parties and entities involved in the Global CommUnity trips, (the “Travel”) that are selected, reserved, and purchased by the Traveler. Please read carefully, as the Agreement is a legally binding document.
CONSENT TO TERMS AND CONDITIONS:
By using Global CommUnity’s services, Traveler accepts and agrees to all of the terms and conditions contained herein. This Agreement governs the relationship between Global CommUnity and you, the “Traveler.” These terms restrict Traveler’s rights and remedies and provide protection to Global CommUnity. They also include warranty disclaimers and liability exclusions. IF THERE IS ANY PART OF THESE TERMS AND CONDITIONS WITH WHICH TRAVELER DOES NOT AGREE, DO NOT USE GLOBAL COMMUNITY’S SERVICES. No alterations to these terms and conditions may be made unless in writing by an authorized officer of Global CommUnity.
INDIVIDUAL ENTRY AND EXIT REQUIREMENTS.
It is solely Traveler’s responsibility to research and be informed of the entry and exit laws of each country Traveler visits and to ensure that Traveler is in conformity with those laws. Many countries may deny or restrict entry to individuals with a criminal history. If Traveler has criminal history, s/he is required to contact the destination country directly for entry and exit requirements. (see: https://travel.state.gov/content/travel/en/international-travel/International-Travel-Country-Information-Pages.html) No members of Global CommUnity’s staff will make such an inquiry or arrangements on Traveler’s behalf.
Travel to certain destinations may involve risk greater than others. It is Traveler’s responsibility to remain informed on current news and travel prohibitions, warnings, announcements, and advisories issued by the United States Government before booking travel to international destinations. The Smart Traveler Enrollment Program (STEP) is a free service provided by the U.S. Government to U.S. citizens traveling to, or living in, a foreign country. STEP allows Traveler to enter information about Traveler’s upcoming trip abroad so that the Department of State can better assist Traveler in an emergency. Registration for STEP is recommended, and it is Traveler’s responsibility to register themself and their family.
BY OFFERING FOR SALE TRAVEL TO PARTICULAR DESTINATIONS, GLOBAL COMMUNITY DOES NOT REPRESENT OR WARRANT THAT TRAVEL TO SUCH POINTS IS ADVISABLE OR WITHOUT RISK, AND IT SHALL NOT BE LIABLE FOR COSTS, DAMAGES, OR LOSSES THAT MAY RESULT FROM TRAVEL TO SUCH DESTINATIONS. TRAVELER’S PARTICIPATION CONSTITUTES THE TRAVELER’S ASSUMPTION OF THE RISK OF SUCH EVENTS.
USE OF GLOBAL COMMUNITY ACCESS AND INFORMATION FOR TRAVEL BOOKINGS.
Traveler warrants that s/he is at least 18 years of age and possesses the legal authority to enter into this Agreement and to make travel bookings with Global CommUnity by any means, including through Global CommUnity’s website. Traveler agrees s/he is financially responsible for all of his/her travel bookings (as well as the use of Traveler’s account by others, including, without limitation, minors living with him/her). Traveler agrees to supervise all usage of Global CommUnity communications by minors under Traveler’s name or account. Traveler also warrants that all information supplied by Traveler or members of Traveler’s household is true and accurate. Without limitation, any speculative, preliminary, fake, false, or fraudulent reservation or any reservation in anticipation of demand without any actual intention of travel is prohibited. Traveler agrees that the travel services reservations facilities provided by Global CommUnity shall be used only to make legitimate reservations or purchases for Traveler or for another person for whom Traveler is legally authorized to act. Separate supplier terms and conditions will apply to Traveler’s reservation and purchase of travel-related goods and services that Traveler select. Traveler agrees to abide by the terms and conditions of purchase imposed by Global CommUnity and any supplier with whom Traveler elects to deal, including, but not limited to, payment of all amounts when due and compliance with the supplier’s rules and restrictions regarding availability and use of fares, products, or services. Traveler understand that any violation of any such supplier’s conditions of purchase may result in cancellation of Traveler’s reservation(s) or purchase, in Traveler’s being denied access to any flights, hotels, cruises, or automobiles, in Traveler’s forfeiting any monies paid for such reservation(s) or purchase, and in Global CommUnity debiting Traveler’s account for any costs Global CommUnity incurs as a result of such violation. Traveler shall be completely responsible for all charges, fees, duties, taxes, and assessments arising out of Traveler’s travel bookings through access provided by Global CommUnity.
PAYMENTS AND CANCELLATION.
Upon booking Traveler’s trip with Global CommUnity, Traveler is required to pay a deposit of 30% of the total cost of Traveler’s trip. Traveler’s final payment is due 90 days prior to the first date of travel unless otherwise specified by Global CommUnity duly authorized agent. If Traveler’s final payment date falls on a weekend, the due date will be the last business day prior to that date. If final and full payment is not received by the applicable due date, reservations are subject to cancellation and deposits will be forfeited. If you choose to cancel your existing reservation for any reason, the all payments that have been made from the cancelled reservation will not be refunded. All cancellation requests must be sent to Global CommUnity in writing at [email protected]. Additionally, all cancellation requests should copy Traveler’s primary booking contact. If Traveler has any questions, or any provisions are unclear, please contact Global CommUnity before making your reservation. All charges will be charged to the credit card authorized by Traveler. UNLESS STATED IN WRITING, AIRLINE RESERVATIONS ARE NOT INCLUDED IN TRAVELER’S TRAVEL PLANS. It is the Traveler’s responsibility to make appropriate air arrangements, as well as transportation to and from the destination where the travel booking originates and returns. Global CommUnity assumes no responsibility for any air and/or ground schedule changes.
In rare instances, upon departure from a country, certain departure taxes must be paid in cash only, and may vary in price. Due to enhanced security, it is strongly recommended that Traveler check-in a minimum of 2 hours prior to scheduled departure for domestic flights and 3 hours prior to scheduled departure for international flights. Travelers should reconfirm flight times at least 24 hours prior to scheduled departure time for domestic flights, and 72 hours prior for international flights. Failure to use a reservation may result in automatic cancellation of all continuing and return flights and forfeiture of airfares.
If Traveler misses his/her transfer or sees that his/her flight will not arrive at the scheduled time, he/she needs to notify Global CommUnity immediately. Global CommUnity will attempt to modify the time of Traveler’s transfer. However, in some cases, it may be necessary to book alternative transportation arrangements resulting in additional fees, which Traveler will be responsible for. Unused services that result from flight cancellations or changes are not eligible for a refund.
Travelers are advised to reserve early to avoid disappointment and late booking fees.
NO REFUNDS FOR UNUSED ARRANGEMENTS.
As Global CommUnity’s prices are based on contract rates and prepaid services, any unused portions of a travel booking are not eligible for a refund. Unused tour documents and components – whether voluntary or caused by airline delay or cancellation or any other reason – are non-refundable. Global CommUnity will not provide refunds or compensation for unused seating upgrades or as a result of a passenger being denied boarding. Should you be denied travel, it is your responsibility to make alternate arrangements. It is your responsibility to arrive at the airport on time and following check-in, to proceed to the correct departure gate by the time specified on your boarding pass. Global CommUnity cannot be held responsible if you miss your flight by failing to comply with these requirements. No responsibility is accepted by Global CommUnity for expenses or lost travel time incurred due to delay, aircraft reroute, change in schedule, or any other causes.
POTENTIAL PRICE INCREASE DISCLOSURE & CONSENT.
PRICES AND AVAILABILITY QUOTED BY GLOBAL COMMUNITY ARE NOT GUARANTEED UNTIL THE BALANCE IS FULLY PAID. Global CommUnity will make every effort to honor the price as originally quoted; however, in some circumstances Suppliers or governments may impose additional costs due to an increase in the cost for one or more of the travel components. Global CommUnity reserves the right to charge Traveler(s) for any increase in taxes, fees, costs, expenses, or surcharges (i.e. fuel). Traveler acknowledges this right and agrees to pay any such additional taxes, fees, costs, expenses, and surcharges.
PRIOR TO FULL PAYMENT, prices for services, including air travel and air tours (in, to, or from the U.S.) could increase for certain services, including, but not limited to, the prices of seats, luggage, fuel surcharges, or government-imposed taxes or fees. U.S. air travel or air tour prices will not increase AFTER MAKING FULL PAYMENT, except for charges resulting from government-imposed taxes or fees. Certain Suppliers (as defined below) reserve the right to increase prices to cover increased costs, fuel surcharges, tariffs, and taxes, and to reflect fluctuations in foreign exchange markets. Traveler expressly acknowledges acceptance of these conditions applicable to purchase and authorizes Global CommUnity to charge Traveler’s credit card for such additional amounts. This consent applies to all travel arranged by Global CommUnity for Traveler that includes scheduled air transportation and may be revoked at any time with respect to future travel for which Traveler has not yet made payment. This consent will expire five (5) years following the date of payment of Traveler’s first travel deposit.
Prices are subject to change based upon currency exchange rate fluctuations, provided actual variations have occurred. Global CommUnity reserves the right to charge Traveler for any surcharges or increases based on currency fluctuation, increases in hotel, guide, driver, and transportation costs (e.g., fuel), airline-imposed surcharges, and government action, such as increases in VAT or any other government-imposed increases. Traveler acknowledges this right and agrees to pay any such additional taxes, fees, costs, expenses, and surcharges
ALTERATIONS TO CONFIRMED BOOKINGS.
If Traveler decides to change any portion of Traveler’s confirmed arrangements prior to departure or during Traveler’s trip, Traveler will be charged an administrative fee of a minimum of $100 per change/per person, depending upon the circumstances of the request. The amount of the administrative charge may vary based on the severity of the services requested, and shall be determined at the sole discretion of Global CommUnity. Changes are subject to availability. Traveler will be responsible for the administrative fee regardless of whether Global CommUnity is able to secure the requested alternative arrangements. No refunds will be given if Traveler cancels a confirmed service.
HEALTH/SECURITY/TRAVEL DOCUMENTATION REQUIREMENTS.
Each Traveler is responsible for making absolutely certain that s/he has received the appropriate immunizations and possesses the required documentation of such immunizations before travel, and must abide by all security rules imposed by any and all applicable government authorities. Global CommUnity does not assume any responsibility for the accuracy of health requirements or vaccination and/or documentation prior to departure or upon landing at the final destination. Traveler should contact his/her primary care physician or medical provider for advice. If Traveler is concerned about taking any medications or receiving certain inoculations, s/he should check with his/her primary care physician or other medical providers BEFORE booking. Traveler should check the U.S. State Department website for relevant information relating to travel to specific destinations and the U.S. Centers for Disease Control relating to health issues. For further information relating to security, safety issues, crime, the need for travel documentation (such as passports, visas, proof of health/vaccination certificates), health hazards, and other restrictions regarding travel to Traveler’s domestic and/or international destination(s), and reentry into the United States, visit www.tsa.gov, www.dot.gov, www.faa.gov.us, www.ustreas.gov, and www.cbp.gov on a regular basis for information regarding incidence of disease, terrorism, safety issues, crime, the need for travel documentation (such as passports, visas, proof of health/vaccination certificates), health hazards, and other restrictions regarding travel to Traveler’s domestic and/or international destination(s), and reentry into the United States, especially Traveler’s embassy and http://www.uscis.gov/ for non-USA citizens. Global CommUnity neither controls nor warrants the issuance of visas related to applicable travel. Should a visa not be issued, Global CommUnity is not responsible for lost payments made toward the contemplated trip. U.S. rules regarding entry and exit change daily. When traveling domestically or internationally, the U.S. Transportation Security Administration (TSA) and U.S. Department of Homeland Security (DHS) advise that everyone carry at least two forms of acceptable identification found http://www.tsa.gov/traveler-information/acceptable-ids. Examples: DHS-designated enhanced driver’s license, U.S. Passport, and a foreign government passport.
Passengers traveling outside the United States are required to carry proof of citizenship. All U.S. citizens must have a valid U.S. passport. Passport cards are not valid for travel to Mexico and the Caribbean. The passport must be valid for six months after the return date of your travel. Minors age 17 and under traveling alone or with a single parent may be required to have additional documentation on international flights. It is your responsibility to secure the current requirements for your particular itinerary and carrier.
In accordance with stricter security measures, it is required that all married passengers whose last name differs from their identification credentials must also provide a copy of their Marriage License Certificate upon check-in for all international flights.
Non-U.S. citizens, including permanent resident card (U.S. Green Card) holders, Travelers must check with the consulate of their intended destination, U.S. authorities, and the air carrier(s) to obtain information on required documentation for entry to the destination and reentry to the U.S.
The above information regarding documentation is subject to change. It is Traveler’s responsibility to obtain current requirements needed for his/her carrier and destination. Global CommUnity will not be liable if Traveler is denied boarding, entry, or reentry due to lack of proper documentation and such passengers will not be entitled to a refund.
Traveler is responsible for familiarizing himself/herself with the laws, rules, and regulations governing aircraft travel. U.S. federal law forbids the carriage of hazardous materials aboard aircraft in the passenger’s luggage or on the passenger’s person. A violation can result in 5 years’ imprisonment and penalties of $250,000 or more (49 U.S.C. 5124). For further information, each passenger should contact the relevant airline representative(s) on their itinerary and go online to www.faa.gov/about/initiatives/hazmat_safety/. Restrictions on hazardous materials are listed here: http://www.tsa.gov/traveler- information/prohibited-items.
Some countries require insecticide spraying of aircraft prior to a flight or while Traveler is on the aircraft. In such cases, federal law requires that Global CommUnity refer Traveler to DOT’s disinfection website at http://www.dot.gov/office-policy/aviation-policy/aircraft-disinsection-requirements. All Travelers are required to check the list of countries that require airlines to treat the passenger cabin with insecticides prior to the flight or while on the aircraft.
E-tickets expire a year from issue date unless carrier fare rules in passenger’s itinerary fare provide otherwise.
PHOTOGRAPHY, USE OF IMAGES .
Global CommUnity reserves the right to take photographs or videos during the operation of any part of the travel and to utilize the resulting images or recordings for promotional or commercial use. By making a reservation, each Traveler consents and agrees to allow his or her likeness to be used by Global CommUnity, its authorized third-parties and the Tour Operator without compensation to the Traveler and without further notification or consent. Copyright to all photographs, video, and related materials created by the Traveler shall belong to the Traveler upon creation, and the Traveler grants to Global CommUnity permission and a non-exclusive irrevocable license to use any such materials provided by Traveler to Global CommUnity.
LIMITATIONS OF RESPONSIBILITY AND DISCLOSURE.
Global CommUnity acts solely as a booking agent for disclosed principal supplier cruise lines, hotels, airlines, air charters, bus companies, ground transportation, boat purveyors or owners, and other independent contractors providing accommodations, transportation, and/or other services (“Supplier(s)”) and is not the source or provider of the travel services. Each Supplier is an independent entity with its own ownership and management and is not subject to the control of Global CommUnity. Traveler is advised that the Suppliers whose names appear in travel documentation are those actually responsible for providing the travel services purchased, and Traveler consents to the use of those Suppliers, and understands and agrees to each Supplier’s Terms and Conditions that are contained in printed form and/or are set forth on their respective websites, which govern the transaction. All bookings are accepted by Global CommUnity as agent for the Suppliers on Traveler’s itinerary. The transportation, accommodations, and other services provided by the identified sea, ground, and air operator Suppliers offered are subject to the terms and conditions contained in the tickets, exchange orders or vouchers issued by the Suppliers, including Terms and Conditions on their respective websites. BECAUSE GLOBAL COMMUNITY ACTS AS AGENT FOR DISCLOSED PRINCIPAL SUPPLIERS AND DOES NOT HAVE THE RIGHT TO CONTROL THE OPERATIONS OF SUCH INDEPENDENT OPERATORS AND SUPPLIERS, TRAVELER AGREES GLOBAL COMMUNITY IS NOT LIABLE FOR ANY PERSONAL INJURY OR PROPERTY DAMAGE, WHICH MAY ARISE OUT OF THESE SERVICES. GLOBAL COMMUNITY HEREBY DISCLAIMS ANY LIABILITY WHETHER BASED ON CONTRACT, TORT, STRICT LIABILITY, OR OTHERWISE, INCLUDING WITHOUT LIMITATION LIABILITY FOR ANY DIRECT, PUNITIVE, SPECIAL, CONSEQUENTIAL, INCIDENTAL, OR INDIRECT DAMAGES, IN CONNECTION WITH THE GOODS OR SERVICES PROVIDED BY ANY PRINCIPAL SUPPLIER BOOKING THROUGH GLOBAL COMMUNITY’S OFFICE OR THROUGH THIS WEBSITE, INCLUDING WITHOUT LIMITATION, LIABILITY FOR ANY ACT, ERROR, OMISSION, INJURY, LOSS, ACCIDENT, DELAY, OR IRREGULARITY THAT MAY BE INCURRED THROUGH THE FAULT, NEGLIGENCE, WILLFUL ACTS, OMISSIONS, OR OTHERWISE OF SUCH SUPPLIER OR OF ANY SUPPLIER OR THEIR RESPECTIVE EMPLOYEES, AGENTS, SERVANTS, OR REPRESENTATIVES, INCLUDING, WITHOUT LIMITATION, THEIR FAILURE TO DELIVER OR THEIR PARTIAL OR INADEQUATE DELIVERY OF SERVICES, FUEL INCREASES AND OTHER MATTERS OUTSIDE OF GLOBAL COMMUNITY’S CONTROL, AND TRAVELER HEREBY RELEASES GLOBAL COMMUNITY FROM ANY LIABILITY WITH RESPECT TO THE SAME. Weather conditions, including but not limited to the presence or absence of snow, sunshine, and rainfall are not guaranteed to occur or not occur, and are clearly outside of Global CommUnity’s control. Volcanic eruptions, ash clouds, and wind may be characterized as an adverse weather condition or a natural disaster by Suppliers and/OR Traveler’s travel insurance company, which is beyond the control of Global CommUnity. Global CommUnity reserves the right to cancel any itinerary or any part of it, to make such alterations in the itinerary as it deems necessary, and to refuse to accept or to retain as a member of any tour any person at any time in its sole and absolute discretion. Global CommUnity shall assume no responsibility for any air and/or ground schedule changes. GLOBAL COMMUNITY HAS RECEIVED COMMISSION AND FEES FOR TRAVEL TRANSACTIONS, AND TRAVELER AGREES AND UNDERSTANDS THAT ANY RECOVERY FROM GLOBAL COMMUNITY WILL BE LIMITED TO THE COMMISSION AND FEES PAID BY TRAVELER AND ACTUALLY RECEIVED BY GLOBAL COMMUNITY IN THE PAST TWELVE MONTHS BEFORE THE ACTION GIVING RISE TO THE LIABILITY.
Global CommUnity, its parent, owners, members, subsidiaries, affiliates, agents, subagents, Suppliers and each of their respective officers, directors, employees, agents, and representatives will not be responsible or liable for any loss, damage, or injury of any nature and of any kind in whole or in part resulting from a force majeure condition including without limitation: act of God, fire, volcanic eruption, environmental pollution or contamination, inclement weather, earthquake, flood, water or power shortages or failures, tropical storms or hurricanes, dangers of the sea, breakdown of machinery or equipment, riots or civil commotions or disturbances and any other acts of similar nature, theft, pilferage, sabotage, arrests, strikes or other labor disruptions, restraints of rulers or peoples, expropriations, acts of terrorism, war, insurrection, strikes, epidemics, restrictions, government health advisories or warnings or alerts of any kind or nature, acts of governments or other authorities de jour or de facto, government seizures, refusal or cancellation or suspension or delay of any government authority or any license, permit or authorization, damages to its facilities, or because of any other cause or causes of any similar nature or any other factor unforeseen by Global CommUnity that impacts negatively on or hampers its ability to fulfill any of its contractual conditions. If any of these conditions apply, Global CommUnity shall be excused, discharged, and/or released from its performance to the extent such performance is so limited or prevented, without liability of any kind.
All Travelers are required to review all travel documents, including their Final Itinerary, for accuracy upon receipt and must contact Global CommUnity within 72 hours with any questions or issues. Failure to notify Global CommUnity of any issues within 72 hours of receipt shall constitute a waiver of any claim regarding accuracy of the travel documents. Transportation services such as trains or flights typically involve restrictions and changing any aspect of the travel arrangements may result in the payment of additional money.
Each airline has specific rules and requirements regarding baggage size, weight, and even design. It is the Traveler’s responsibility to make sure that baggage brought on any flight adheres to the size, weight, and design requirements of the airline. Smaller planes or helicopters often require smaller and lighter baggage. Most airlines charge fees for baggage that exceeds their weight and size requirements. On smaller planes and helicopters, oversized luggage or baggage that is too heavy may not be allowed on the flight for safety reasons. Questions regarding airline requirements should be directed to the airline.
COMPLAINTS & REFUNDS.
We understand that travel can be a significant investment, and sudden unexpected occurrences may end up interfering with your plans. However, once Travelers purchase their trip through Global CommUnity, Global CommUnity uses some or all of that money to secure the Traveler’s trip or accommodations from its Suppliers and travel partners. Oftentimes, the Suppliers and travel partners do not provide refunds once a trip is reserved. Therefore, GLOBAL COMMUNITY IS NOT ABLE TO REFUND PAYMENTS TO TRAVELERS FOR ANY REASON. All Travelers are STRONGLY encouraged to purchase travel or trip insurance when booking their trip, INCLUDING “CANCEL FOR ANY REASON” INSURANCE. While Global CommUnity will do its best to ensure that Traveler’s trip runs smoothly, issues may occur outside of its control. If a problem arises during Traveler’s vacation, please inform Global CommUnity and its local partners (contact details will be outlined in Traveler’s final documents) immediately. Although Global CommUnity and its travel partners will make every effort to adhere to the Final Itinerary, on some occasions it may be necessary to make an adjustment to Traveler’s arrangements. Should such adjustment be necessary, a substitute will be offered when and where possible. NO REFUNDS FROM GLOBAL COMMUNITY WILL BE PROVIDED FOR ANY REASON AT ANY TIME.
In the event Traveler’s travel insurance provider denies Traveler’s claim, or does not fully pay Traveler’s claim, Global CommUnity will not be responsible for any uncovered or unreimbursed costs or expenses for any reason.
METHODS OF CONTACT.
Traveler authorizes Global CommUnity to contact him/her from time-to-time via email, phone, or text message at the email address or telephone number(s) provided when booking the reservation. Please note that message and data rates may apply. The purpose of the communications is to discuss the status of Traveler’s travel products and/or services purchased by Traveler, to tell Traveler about additional products and services for which he/she may qualify and other business purposes. Traveler may withdraw consent at any time.
If any paragraph of these Terms and Conditions shall be declared invalid or void by any court, such declaration shall not invalidate the entire Agreement and all other paragraphs of these Terms and Conditions shall remain in full force and effect. The parties agree any claim or litigation arising out of or relating to this these Terms and Conditions, or the breach or validity thereof, shall be brought in Davidson County, Tennessee, the location of Global CommUnity’ corporate offices, and the governing law shall be the laws of the State of Tennessee, without giving effect to the principles of conflict of laws thereof.. Traveler agrees that if any civil proceeding, arbitration, mediation or action of any kind, is commenced by Traveler against Global CommUnity or any of its agents, affiliates, officers, assignees or employees, the limit on any damages, which includes, but is not limited to, damages, interest, court costs, attorney fees, expenses of litigation, and punitive damages shall be the amount Traveler paid Global CommUnity for the services that is the subject matter of these Terms and Conditions.
